Recognize experts for earthworks and foundation engineering
Source: BUS Rheinland-PfalzParticularly competent and qualified persons in the field of assessing the subsoil and its load-bearing capacity of structures can apply for recognition as experts for earthworks and foundation engineering in order to be able to check the accuracy of the information on the subsoil on behalf of the client during the building permit procedure.
The application for recognition must be submitted in writing to the Ministry of Finance as the highest building supervisory authority. It must also state whether and how often a recognition procedure as an expert for earthworks and foundation engineering, including outside the state of Rhineland-Palatinate, has been unsuccessful.
Submission of proof of the recognition requirements. Examination of the recognition requirements by the recognition authority.
Proof of professional suitability by examination by the advisory board of the Federal Chamber of Engineers.
Recognition and presentation of certificate.
The recognition authority is the Ministry of Finance as the highest building supervisory authority.
The requirements for registration can be found in the state ordinance on experts for earthworks and foundation engineering in "§ 2 Requirements for recognition".
The application must be accompanied by the required information and evidence in accordance with Section 3 (2) of the State Ordinance on Experts for Earthworks and Foundation Engineering, in particular
- a certificate of citizenship,
- a curriculum vitae with full details of the professional career and professional activity up to the date of application,
- transcripts or photocopies of university degree certificates and all certificates relating to previous employment,
- a declaration that an application has been made for a certificate of good conduct for submission to an authority (Section 30 (5) of the Federal Central Criminal Register Act) or an equivalent document from a Member State of the European Union or a country with equivalent status under European Community law; the certificate of good conduct or equivalent document should not be more than three months old,
- proof of the existence of the prerequisites pursuant to § 2 para. 1 sentence 1 nos. 2 to 9, whereby the existence of the prerequisite pursuant to § 2 para. 1 sentence 1 no. 4 must be proven by an expert opinion of the Advisory Board pursuant to § 4,
- Details of any branches,
- a declaration that there are no grounds for failure pursuant to Section 2 (3), and
- details of any participation in a company whose purpose is the planning and execution of construction projects.
For participation in the recognition procedure, fees in accordance with No. 3.4.2 of the Special List of Fees of January 9, 2007 (GVBl. p. 22), as amended, are currently charged in the amount of EUR 800.00; in addition, the costs for the preparation of the expert opinion of the Advisory Board, which exists at the Federal Chamber of Engineers, on the professional suitability are charged separately as expenses (cost limit EUR 2,500.00).

A decision on the application for recognition must be made within three months of submission of the complete application documents (Section 42a of the Administrative Procedure Act).
Action under the Administrative Court Code.
The application for recognition as an expert for earthworks and foundation engineering must be submitted to the recognition authority. The application can be submitted informally.
